Ownership Transfer: Documents Required and Process

When a vehicle is sold, the name of the purchaser is recorded as the registered owner instead of the previous registered owner, known as ownership transfer.

Transfer of ownership on death of vehicle owner 

When the registered owner of a vehicle dies, the transfer of ownership shall be in favour of the legal heirs of the deceased registered owner.

When the owner of a vehicle dies, the person transferring ownership of the vehicle may use the vehicle for three months as if he had transferred it to him, provided that he notifies the registration authority of the death of the vehicle within 30 days of transferring ownership of the vehicle to the registration authority.

Transfer of ownership of vehicles purchased at public auction

When a vehicle is sold at public auction, the name of the purchaser is recorded as the registered owner instead of the previous registered owner and this process is known as transfer of ownership.

Ownership Transfer: Guidelines

  • Transfer of ownership in case of normal sale

When the ownership of a motor vehicle is transferred, the transferor shall report the transfer using Form 29 to the concerned registering authority having jurisdiction over the residence or place of business of the transferor and the transferee.

In case of a vehicle registered in the same State, the ownership transfer transferee shall apply for the transfer of ownership of a motor vehicle under Form 30 to the registering authority within 14 days of the transfer along with the forms listed in Form I below.

In case of a vehicle registered outside the State, the transferee shall apply for transfer of ownership of a motor vehicle under Form 30 to the registering authority within 45 days of the transfer along with Form I and Form 30 to be provided along with Form II below.

Pay the appropriate dues and taxes as per Rule 81 of the Central Motor Vehicles Rules, 1989.

  • Transfer of ownership on death of the vehicle owner

Apply to the Registrar in Form 31 within three months to transfer the ownership of the vehicle into your name. Pay the appropriate fees and taxes as per Rule 81 of the Central Motor Vehicles Rules, 1989.

  • Transfer of Ownership of Vehicle Purchased at Public Auction

A person who has purchased a motor vehicle at a public auction conducted by or on behalf of the Central Government or State Government must submit an application to the Registrar in Form 32 within 30 days of receipt of the vehicle.

Pay the appropriate fees and taxes as per Rule 81 of the Central Motor Vehicles Rules, 1989.

  • Clearance Certificate issued by the Registering Authority Order from the Registering Authority refusing to issue Clearance Certificate.
  • If no authorization certificate or order has been received, a statement from the transferor that no such notice has been received and:
  • The receipt received from the licensing authority, or if the application for a certificate of approval was submitted by mails, a postal confirmation from the licensing authority.

Transfer of ownership of vehicle purchased at public auction

  • Certificate or order duly signed by the person authorised to conduct the auction confirming the sale of the vehicle and
  • Attested copy of the  Central or State Government order authorising the auction of the vehicle Pollution Prevention Certificate*

  • Pencil imprint of chassis and engine*
  • Proof of Date of Birth Purchaser*
